Judicial Panel to Reconsider Ruling That Allowed Trump to Send Military Forces to Oregon City

The ninth circuit court has upheld a prohibition on deploying national guard in the Oregon city, following a latest legal decision.

Appeals Court Agrees to Rehear Case

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the executive power with an larger panel of 11 judges. The court also overturned a previous ruling from a smaller judicial group that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent turn in a long-running court case over whether the former president has the legal right and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The administration has argued that government employees at the immigration center in the southern part of the city were facing threats, while city and state officials maintain that municipal police have control of the circumstances.

In defiance of characterizations of Portland as “war ravaged”, residents have been sharing footage of scenic paths and a vibrant culinary culture, and planning activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland issued two temporary restraining orders this month – one blocking the federal control of the Oregon national guard, and another stopping the deployment of any national guard troops in Oregon, after attempts to circumvent the first order by calling up out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of 200 Oregon national guard – but the second ruling remained in place, blocking the actual deployment of the forces.

The latest ruling means the issue will be heard by the full court – with all decisions under review simultaneously – by a panel of 11 judges.

“This ruling shows that facts are important and that the judicial system are working to hold this administration accountable. The constitution restricts the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a official comment.

“The judicial body is sending a clear message: the executive leader cannot send the military into US cities unnecessarily. We will continue protecting Oregon’s laws, principles, and autonomy as this legal proceeding progresses and our legal battle continues in the judicial system.”
